1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Roamix governing your access to and use of the Service. By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these terms and by any policies expressly incorporated by reference.

If you do not agree to these terms, you must not access or use the Service.

2. Definitions

For purposes of these terms, the Service means the Roamix website, account interface, checkout workflow, and related eSIM offerings. A Plan means a digital data product with defined data allowance, validity period, and destination coverage. Activation means the event that starts usage under a Plan according to the applicable product terms, including installation, first network session, or commencement of a defined activation window. An Order means a purchase that has been accepted and confirmed by Roamix.

3. Eligibility and Account Registration

You represent that you are at least eighteen years of age or the age of majority in your jurisdiction and have legal capacity to enter into this agreement. You agree to provide accurate, current, and complete account information and to update that information as necessary to keep it accurate.

You are solely responsible for safeguarding your credentials and for all activities that occur under your account. You must promptly notify Roamix of any suspected unauthorized access, compromise, or misuse of your account.

4. Service Description

Roamix provides access to digital eSIM data plans for compatible devices through third party telecommunications and fulfillment partners. Coverage, quality, speed, and continuity of service depend on external networks and local conditions that are outside Roamix control.

Service performance may vary based on device capability, destination, radio environment, network congestion, and partner network policies.

5. Account Security and Communications

You consent to receive communications from Roamix that are necessary for account administration and service delivery, including receipts, activation instructions, support responses, security alerts, and policy updates. These communications are considered part of the Service.

You are responsible for maintaining current and accessible contact information so that important notices can be delivered in a timely manner.

6. Purchases and Payments

Prices are displayed at checkout and are generally denominated in United States dollars unless stated otherwise. Payment is due at the time an Order is submitted. Applicable taxes, foreign exchange charges, and payment processor fees may apply based on location and payment method.

Roamix may correct clerical, pricing, or product description errors before fulfillment. If a correction materially affects your Order, Roamix may cancel the affected Order and return amounts paid for that Order.

7. Device Compatibility and Activation

You are responsible for verifying before purchase that your device is carrier unlocked, eSIM compatible, and technically capable of using the selected Plan. Plan limits, validity windows, and geographic coverage are presented on applicable product and order pages and form part of the Order terms.

Activation occurs as specified for the selected Plan and may occur upon installation, first network use, or according to a published activation schedule. Roamix is not responsible for service failures caused by incompatible devices, device lock restrictions, incorrect installation procedures, or disabled device settings required for roaming data usage.

8. Refund Policy

You may request a refund within 14 days of purchase only if the eSIM has not been activated. Approved refunds are subject to an administrative fee that is deducted from the refund amount.

Refunds are not available for activated eSIMs, partially used plans, expired plans, or purchases made outside the 14 day period, except where required by law.

To request a refund, you must contact support@roamix.app with your order number and purchase email address. Roamix may request additional information reasonably necessary to verify eligibility and process the request.

All refund determinations, including approval status and applicable administrative fee, are made after eligibility review and payment verification.

9. Acceptable Use

You agree not to use the Service in any unlawful, fraudulent, abusive, or unauthorized manner. Prohibited conduct includes unauthorized resale, interference with network operations, attempts to defeat security controls, and use that violates applicable law, third party rights, or partner network rules.

Roamix may investigate suspected violations and may take appropriate remedial action, including suspension or termination, and cooperation with law enforcement where legally required.

10. Third Party Services

The Service depends in part on third party providers, including payment processors, telecommunications partners, and infrastructure vendors. Roamix is not responsible for outages, interruptions, or failures caused by third party systems or services.

Your use of third party services is governed by the applicable third party terms and privacy policies.

11. Service Availability and Changes

Roamix may add, modify, suspend, or discontinue any feature or component of the Service where reasonably necessary for security, legal compliance, operational integrity, or product improvement. Roamix will use commercially reasonable efforts to limit material disruption.

12. Intellectual Property

All rights, title, and interest in and to the Service, including software, design, content, trademarks, and related intellectual property, are owned by or licensed to Roamix. Subject to these terms, Roamix grants you a limited, revocable, non exclusive, non transferable license to access and use the Service solely for lawful personal use.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an as is and as available basis. Roamix makes no warranty that the Service will be uninterrupted, error free, secure, or available at any specific speed or in every location.

Roamix disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, except to the extent such disclaimers are prohibited by law.

14. Limitation of Liability

To the maximum extent permitted by law, Roamix and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunity arising out of or related to the Service.

To the maximum extent permitted by law, the aggregate liability of Roamix for all claims arising out of or relating to the Service shall not exceed the amount paid by you for the affected Order during the twelve month period preceding the event giving rise to the claim.

15. Indemnification

You agree to defend, indemnify, and hold harmless Roamix and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising from or related to your breach of these terms, misuse of the Service, or violation of applicable law or third party rights.

16. Suspension and Termination

Roamix may suspend, restrict, or terminate access to the Service immediately where Roamix reasonably determines that fraud, abuse, security risk, legal non compliance, or a material breach of these terms has occurred or is likely to occur. You may discontinue use of the Service at any time.

Any provision that by its nature should survive termination will survive, including provisions regarding payments, intellectual property, warranty disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

17. Governing Law and Venue

These terms and any dispute arising out of or relating to these terms or the Service are governed by the laws of the jurisdiction identified in your order or account notices, excluding conflict of law principles. Unless applicable law requires otherwise, each party submits to the exclusive jurisdiction of courts located in that jurisdiction.

18. Changes to These Terms

Roamix may amend these terms from time to time. Updated terms become effective when posted, unless a later effective date is stated. Your continued use of the Service after the effective date constitutes acceptance of the revised terms.

19. Miscellaneous

If any provision of these terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect. A failure to enforce any provision is not a waiver of future enforcement. You may not assign or transfer any rights or obligations under these terms without Roamix prior written consent.
