1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you and Roamix governing your access to and use of the Service. By creating an account, signing in with Google or Apple, placing an order, redeeming a code, or otherwise using the Service, you agree to be bound by these terms and by any policies expressly incorporated by reference, including our Privacy Policy.

If you do not agree to these terms, you must not access or use the Service.

2. Definitions

For purposes of these terms, the Service means the Roamix website, mobile apps and widgets, account interface, checkout workflow, and related eSIM offerings. A Plan means a digital data product with defined data allowance, validity period, and destination coverage. Activation means the event that starts usage under a Plan according to the applicable product terms, including installation, first network session, or commencement of a defined activation window. An Order means a purchase that has been accepted and confirmed by Roamix.

Roamix Omni means the pay as you go eSIM described in Section 8, and Omni Balance means the prepaid balance used to pay for data on it. Roamix Wallet means the store credit balance on your account described in Section 9, and Wallet Credit means any amount in it. Roamix Rewards means the tier program described in Section 10. Spend means the amount you actually paid for Plans, data top-ups and Omni Balance, not counting any part paid with Wallet Credit, and not counting failed or refunded purchases.

3. Eligibility and Account Registration

You represent that you are at least eighteen years of age or the age of majority in your jurisdiction and have legal capacity to enter into this agreement. You agree to provide accurate, current, and complete account information and to update that information as necessary to keep it accurate.

Each person may hold one Roamix account. If you sign in with Google or Apple using an email address that already belongs to a Roamix account, the sign in is linked to that account. Creating additional accounts to obtain promotions, referral rewards, or free trials more than once is prohibited.

You are solely responsible for safeguarding your credentials and for all activities that occur under your account. You must promptly notify Roamix of any suspected unauthorized access, compromise, or misuse of your account.

4. Service Description

Roamix provides access to digital eSIM data plans for compatible devices through third party telecommunications and fulfillment partners. Roamix offers fixed Plans with a set data allowance and validity period, and, where available, Roamix Omni, a pay as you go eSIM. Coverage, quality, speed, and continuity of service depend on external networks and local conditions that are outside Roamix control.

Service performance may vary based on device capability, destination, radio environment, network congestion, and partner network policies. Some features, including Roamix Omni and its free trials, may be available only in certain apps, regions, or to certain accounts.

5. Account Security and Communications

You consent to receive communications from Roamix that are necessary for account administration and service delivery, including receipts, activation instructions, low balance and top up notices, reward and expiry reminders, support responses, security alerts, and policy updates. These communications may be sent by email, in the app, or as push notifications if you allow them, and are considered part of the Service. You can turn off marketing emails and push notifications at any time.

You are responsible for maintaining current and accessible contact information so that important notices can be delivered in a timely manner.

6. Purchases and Payments

Prices are displayed at checkout and are generally denominated in United States dollars unless stated otherwise. Payment is due at the time an Order is submitted. Applicable taxes, foreign exchange charges, and payment processor fees may apply based on location and payment method.

Payments are handled by our payment processor. Cards you pay with may be saved to your account so you can use them again, and you can remove a saved card at any time. Roamix does not store full card numbers.

Only one code, either a promo code or a referral code, can be used on an Order. On Plan orders, a code cannot be combined with Wallet Credit. Codes cannot be used on data top-ups, and on Roamix Omni they apply only to your first Omni purchase.

Roamix may correct clerical, pricing, or product description errors before fulfillment. If a correction materially affects your Order, Roamix may cancel the affected Order and return amounts paid for that Order.

7. Device Compatibility and Activation

You are responsible for verifying before purchase that your device is carrier unlocked, eSIM compatible, and technically capable of using the selected Plan. Plan limits, validity windows, and geographic coverage are presented on applicable product and order pages and form part of the Order terms.

Activation occurs as specified for the selected Plan and may occur upon installation, first network use, or according to a published activation schedule. Roamix is not responsible for service failures caused by incompatible devices, device lock restrictions, incorrect installation procedures, or disabled device settings required for roaming data usage.

8. Roamix Omni

Roamix Omni is a single eSIM that works across supported destinations and is paid for from your Omni Balance. Each account may have one Roamix Omni eSIM. Data is charged against your Omni Balance at the rate published for the network you connect to, which may differ between networks in the same country. Rates are shown on our website and in the app and may change; usage is charged at the rate in effect when it occurs. When your Omni Balance runs out, data stops until you add more.

You can add Omni Balance in amounts between $10 and $500 per purchase. Paid Omni Balance does not expire. Omni Balance is not Wallet Credit: it cannot be spent on Plans, transferred to another account, or exchanged for cash, except as a refund under Section 13.

Auto top-up. If you turn on auto top-up, you authorize Roamix to charge the saved card you choose, without asking you each time, for the amount you set whenever your Omni Balance falls below the threshold you set. Unless you change them, the threshold is $5 and the amount is $25. You can change the card, the amounts, or turn auto top-up off at any time in your account. If a charge is declined or needs your confirmation, auto top-up is turned off and we will let you know.

Usage information from our network partners can be delayed, so your displayed balance may briefly lag behind your actual use. Cancelling a Roamix Omni eSIM is permanent and the eSIM cannot be reactivated.

9. Roamix Wallet

Wallet Credit is store credit. It has no cash value, cannot be withdrawn, sold, or transferred to another account, and is not a deposit or stored value product. Wallet Credit can be earned through cash back, referrals, promo codes, and refunds of amounts originally paid with Wallet Credit.

Wallet Credit can be used toward Plans and data top-ups. When Wallet Credit covers only part of a purchase, at least $0.70 must be paid by card. Wallet Credit cannot pay for Roamix Omni at checkout, but you can move Wallet Credit to your Omni Balance from your wallet. A move to Omni cannot be reversed.

Cash back expires 365 days after it is earned. Other Wallet Credit does not expire. When you spend Wallet Credit, the credit closest to expiring is used first. Expiry dates are shown in your wallet.

If you delete your account, any remaining Wallet Credit and Omni Balance is forfeited.

10. Roamix Rewards

Your tier is based on your lifetime Spend. Tiers never expire or reset. The current tiers are:

Roamer: from $0 lifetime Spend, 3% cash back
Silver: from $25 lifetime Spend, 5% cash back, 3% Omni bonus
Gold: from $75 lifetime Spend, 7% cash back, 6% Omni bonus
Platinum: from $250 lifetime Spend, 10% cash back, 10% Omni bonus
Elite: from $500 lifetime Spend, 15% cash back, 15% Omni bonus

Cash back is added to your Roamix Wallet on Plans and data top-ups, calculated on the amount paid by card, not on any part paid with Wallet Credit. The Omni bonus is extra Omni Balance added on Omni Balance you pay for by card, not on credit moved from your wallet, trial credit, or bonuses. Cash back and the Omni bonus never both apply to the same purchase. Neither applies to a purchase that uses a promo code, coupon, or referral discount or bonus. Rewards use the tier you held before the purchase.

If a purchase is refunded, the cash back or Omni bonus earned on it will be taken back, up to the amount still in your Roamix Wallet or Omni Balance. Roamix may change tier thresholds and rates for future purchases. Rewards already earned are not affected.

11. Refer a Friend

You can invite friends once your lifetime Spend reaches $10. Your friend must be new to Roamix and add your code at checkout or in their account, or sign up from your invite link, before their first purchase.

Only your friend's first purchase counts, and it must be made within 30 days of opening their account. It must include a single Plan, or a Roamix Omni top-up, of $10 or more before discounts. Several cheaper Plans do not add up to that amount.

On a Plan order your friend gets $3 off at checkout. On a Roamix Omni top-up they get $3 extra Omni Balance. A referral discount cannot be combined with a promo code, or on a Plan order with Wallet Credit. Once your friend has paid, you get $3 Wallet Credit.

If the qualifying purchase is refunded, the referral is reversed: up to $3 is taken back from your Roamix Wallet and your friend's referral bonus is removed. Each account can be referred once. Self referrals, duplicate accounts, and other abuse void rewards.

12. Promo Codes and Free Trials

Promo codes are issued at Roamix discretion, may carry their own conditions, expiry dates, and redemption limits, and have no cash value. Redeeming a code may require a verified email address.

Roamix may offer Roamix Omni free trials that add trial credit to your Omni Balance for a set number of days. Each account, and each phone, may receive one Omni free trial ever. A trial code may require that you redeem it in the Roamix app on a genuine phone, which we check using Apple or Google device verification, and that you have a saved debit or credit card. Prepaid cards and cards already used for another account's trial may be refused.

Trial credit is used before your paid Omni Balance. When the trial ends, any unused trial credit is removed; your own paid Omni Balance is not affected. Trial credit has no cash value, cannot be refunded or moved to your wallet, and does not count toward Spend. Roamix may end a trial early where it reasonably suspects abuse.

13. Refund Policy

You may request a refund within 14 days of purchase only if the eSIM has not been activated. Approved refunds are subject to an administrative fee that is deducted from the refund amount.

Refunds are not available for activated eSIMs, partially used plans, expired plans, or purchases made outside the 14 day period, except where required by law.

The same rule applies to Roamix Omni: Omni Balance purchases can be refunded only if you request it within 14 days of purchase and your Roamix Omni eSIM has not been installed. Once the eSIM is installed, Omni Balance is not refundable, except where required by law. Trial credit, bonuses, and balance moved from your Roamix Wallet are never refundable to your card.

Any part of a refunded purchase that was paid with Wallet Credit is returned to your Roamix Wallet, not to your card. Refunding a purchase may also reverse cash back, Omni bonuses, and referral rewards connected to it, as described in Sections 10 and 11.

To request a refund, you must contact support@roamix.app with your order number and purchase email address. Roamix may request additional information reasonably necessary to verify eligibility and process the request.

All refund determinations, including approval status and applicable administrative fee, are made after eligibility review and payment verification.

14. Acceptable Use

You agree not to use the Service in any unlawful, fraudulent, abusive, or unauthorized manner. Prohibited conduct includes unauthorized resale, interference with network operations, attempts to defeat security controls or device verification, gaming promotions, rewards, referrals, or free trials, and use that violates applicable law, third party rights, or partner network rules.

Roamix may investigate suspected violations and may take appropriate remedial action, including withholding, reversing, or cancelling rewards, Wallet Credit, trial credit, or referral rewards obtained through abuse, suspension or termination, and cooperation with law enforcement where legally required.

15. Third Party Services

The Service depends in part on third party providers, including payment processors, telecommunications partners, sign in providers, and infrastructure vendors. Roamix is not responsible for outages, interruptions, or failures caused by third party systems or services.

Your use of third party services is governed by the applicable third party terms and privacy policies.

16. Service Availability and Changes

Roamix may add, modify, suspend, or discontinue any feature or component of the Service, including Roamix Omni, Roamix Rewards, Refer a friend, and promotions, where reasonably necessary for security, legal compliance, operational integrity, or product improvement. Rewards already earned stay in your Roamix Wallet unless they are reversed under these terms. Roamix will use commercially reasonable efforts to limit material disruption.

17. Intellectual Property

All rights, title, and interest in and to the Service, including software, design, content, trademarks, and related intellectual property, are owned by or licensed to Roamix. Subject to these terms, Roamix grants you a limited, revocable, non exclusive, non transferable license to access and use the Service solely for lawful personal use.

18. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an as is and as available basis. Roamix makes no warranty that the Service will be uninterrupted, error free, secure, or available at any specific speed or in every location.

Roamix disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, except to the extent such disclaimers are prohibited by law.

19. Limitation of Liability

To the maximum extent permitted by law, Roamix and its affiliates, officers, directors, employees, and agents are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunity arising out of or related to the Service.

To the maximum extent permitted by law, the aggregate liability of Roamix for all claims arising out of or relating to the Service shall not exceed the amount paid by you for the affected Order or Omni Balance during the twelve month period preceding the event giving rise to the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless Roamix and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising from or related to your breach of these terms, misuse of the Service, or violation of applicable law or third party rights.

21. Account Deletion, Suspension and Termination

You may delete your account at any time from your account settings. Deletion is permanent: your personal details are removed, saved cards are deleted, auto top-up is turned off, and remaining Wallet Credit and Omni Balance are forfeited. Records of past orders and payments are kept as described in our Privacy Policy.

Roamix may suspend, restrict, or terminate access to the Service immediately where Roamix reasonably determines that fraud, abuse, security risk, legal non compliance, or a material breach of these terms has occurred or is likely to occur.

Any provision that by its nature should survive termination will survive, including provisions regarding payments, intellectual property, warranty disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

22. Governing Law and Venue

These terms and any dispute arising out of or relating to these terms or the Service are governed by the laws of the jurisdiction identified in your order or account notices, excluding conflict of law principles. Unless applicable law requires otherwise, each party submits to the exclusive jurisdiction of courts located in that jurisdiction.

23. Changes to These Terms

Roamix may amend these terms from time to time. Updated terms become effective when posted, unless a later effective date is stated. Your continued use of the Service after the effective date constitutes acceptance of the revised terms.

24. Miscellaneous

If any provision of these terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permitted and the remaining provisions shall remain in full force and effect. A failure to enforce any provision is not a waiver of future enforcement. You may not assign or transfer any rights or obligations under these terms without Roamix prior written consent.
